In 2019, in the midst of widespread concern over the safety and purity of cannabis and tobacco vapes, Oregon Governor Kate Brown ordered a ban on botanically-derived terpenes being used to flavor cannabis vapes. We led the team that successfully challenged this ban, and the Oregon Court of Appeals overturned the ban, saving dozens of businesses and hundreds of jobs.
We represented a hemp farmer who grew acres of high-quality CBG hemp on his family farm. When he contracted with a processor to turn it into distillate, the distillate they gave him was less than half the quantity it should have been and tested at around 25% CBG and 54% CBD. After the processor refused to take accountability for its substandard processes, the farmer hired us. At arbitration, we leaned heavily on experts, who testified about the extraction process, the testing methodology in the field, and the value of the hemp. The arbitrator agreed with our arguments, and awarded our client his expectation damages, as well as attorney and expert fees.
